- 1. Reservation
All reservations are made online, the party leader; he/she must be over 21, and authorised by all members of the party, who are listed on the booking form, to accept our booking conditions on their behalf and be authorised to make any amendments to the booking on behalf of the whole party. By your completion and submission of the booking form online, it is deemed that you have read and agreed to abide by these terms and conditions. Everyone occupying the property (including an overnight stay) must be listed on the booking form, including infants. This is Florida State Law and must be adhered to. Any unauthorised occupancy by people not named will be subject to immediate termination of the rental agreement. Contravention to this rule will render your booking void, all monies forfeited, and you will be asked to leave the property without any refund or compensation.
All documentation will be sent to the party leader by email, who should duly appraise the other party members of any information.
Bookings are reserved for 7 days pending receipt of the non-refundable deposit being £200/$400. Our home is booked solely for use of those persons named on the booking form unless agreed in writing (email) with the owners/booking agent.
- 2. Payment
The outstanding rental balance is payable 8 weeks prior to your arrival at the property. If you were to book the home less than 8 weeks prior to your arrival, then the full balance would be due immediately. Payment can be made by UK bank transfer or debit/credit card on most homes. When paying by card if the amount is not in US$ then it will be converted using the current business exchange rate at that time. We are not responsible for any variations in the exchange rate or any charges your bank or card issuer may apply.
Property’s 2809, 2811, 344 and 7912 all payments are via PayPal or UK bank transfer.
If you would like to make any changes to your booking after the final balance has been paid this will incur a £30/$50 administration fee.
Changes such as the addition of BBQ’s, Pool/Spa Heat, use of Hot tub (7912 only), Baby equipment, Welcome Packs cannot be guaranteed with less than 8 weeks to arrival and should be requested at the time of booking.
- 3. Security Bond Waiver
A security bond waiver of £50/$69 is added to all bookings. This is payable with the final balance. You are still responsible for any loss or damage to the property. The waiver is paid rather than putting up a large bond.
The guest party agree to undertake the following: -
• To take diligent care of the property and leave it in a clean and tidy condition at the end of the occupancy
• All keys are returned to the lock box, failure to do so will result in a change of locks at a cost to you of $150
• To report any damage or loss immediately to our Management Company, their details can be found in the villa and in the check in details
• Upon arrival if you are not happy with something please report it to the Property Manager within 24 hours of arrival, they will endeavour to rectify the problem within a timely manner, any claims for compensation will not be considered if you have not reported it
• To make good minor breakages
• To permit the Owner, booking agent, Property Manager or their servants reasonable access to the property to carry out any maintenance deemed necessary.
• Any stains to the carpets, bedding or furniture must be cleaned and removed and reported to the property management company
We reserve the right to pursue the party leader for any loss or damages that have occurred during the period of occupancy.
- 4. Cleaning Fee
There is a charge to clean the home on departure this is mandatory and is added onto all bookings and payable with the final balance. The property will be cleaned for your arrival. Should you require extra cleaning during your stay this can be arranged but there will be an extra charge. Please contact the owner/booking agent at least 2 weeks before you arrive for this to be arranged.
- 5. If you have to cancel your holiday
If unfortunately, any member of your party needs to cancel the booking, we would ask that we be informed immediately in writing (email), by the party leader. Cancellation will be effective from the date it is received by us. Cancellations are subject to a charge detailed below: -
• A cancelation of a booking up to 8 weeks before you travel – Loss of Deposit
• A cancellation of a booking that is within 8 weeks before you travel or after the full amount has been invoiced or paid – Loss of all money paid or due
Any reservation obtained under false pretence will be subject to forfeiture of advance payment, deposit and/or rental money, the party leader and the party will not be permitted to check in
No refunds are given if the party elect to leave the property early.
- 6. If we change or cancel your holiday
In the unlikely event that due to circumstances beyond our control, we need to make changes to or cancel you’re booking, we will inform the party leader as soon as possible using the email address provided on the booking form. In the first instance we will always try and move your booking into a home of the same value. If a home of the same value isn’t available, we may offer you a lower value home and refund the difference. If a home is not available, then a full refund will be given of any monies paid. In any circumstances we will not be liable for any form of compensation payments or reimburse you for any expenses you may incur. Your travel insurance may cover you for these events.
- 7. Occupancy
The homes maximum sleeping capacity must not be exceeded, to comply with the State of Florida fire regulations.
You may occupy the home from 4 pm on the first day of your confirmed rental period until 10am on the final date of your confirmed rental period.
County rules for safety and insurance purposes are strictly enforced.
- 8. Check in and check out times
Check in is after 4pm on the day of arrival and check out no later than 10am on the day of departure. Should you require a variation to this then please check with the owner/booking agent 3 days prior to arrival or departure. However, we cannot guarantee that we will be able to accommodate you but if we can there is a £50/$75 fee. Should you arrive early or depart late without prior authorisation from the Owner/Booking Agent then a $100 fee will be charged.
- 9. No Smoking, Pets, Drugs or Firearms
We have a strict no smoking/no pet’s policy inside the home and on the patio/lanai. Smoking is only permitted away from the home. We do not allow drugs or firearms in or around the property. If you were to breach any of the smoking, pets, drugs or firearms rules you would be asked to leave, forfeiting your stay and any payments or deposits made.
- 10. Swimming Pool/Spa and Hot tubs
(Only property 7912 has a stand alone hot tub)
The pool, spa and hot tub will be cleaned weekly. There is a net provided and there may be times when you will need to remove debris/bugs from the pool, this may increase during rainy periods.
The recommended temperature for outside pools is 65-70 degrees however, the actual temperature will be dependent on the outside ambient air temperature.
Please understand if you have decided to take pool heating it is only designed to take the chill off the pool. Some homes supply pool covers, if one has been supplied please use it from October to April as this will help to retain the heat during the night.
Children should be under adult supervision at all times in the pool, spa and hot tub area. Spas and hot tubs are not recommended for children under 16, it is at your discretion as to whether you allow them to use these facilities. Diving is not allowed in the pool. Please adhere to the pool safety instructions at the property.
Please note only property 7912 Rolling Hills has a stand alone hot tub, this can only be access if you have paid the extra fee of £10/$15 per night.
- 11. Telephone calls incl. 911 Calls
Most homes include local calls and 911 emergency calls for free.
- 12. Personal Safety
The owners cannot accept any liability for your personal safety during your stay at the property. Guests are reminded to exercise care as to personal safety of themselves and all-party members. Wherever possible, valuables should be left secure and out of sight.
- 13. In case of complaint
Things do occasionally go wrong, and we promise you we shall make our best endeavours to rectify faults to your satisfaction. You must inform our local management company immediately in order that the problem may be documented and rectified as soon as possible. If you are not satisfied with the solution, please make this known to us in writing (email) to floridavillas@hotmail.com within 7 days of you vacating the home. Any offers of compensation that we make will only be valid for 7 days, after this time it will be null and void. We will not accept liability for any dissatisfaction or other complaints not reported to our management company during your stay. The owners/booking agent nor their Management Company cannot be held responsible if any of the Resorts facilities are not available during the rental period. Facilities and other features on our adverts or web page may not always be available. We will endeavour to communicate any shortfall to the party leader by email as soon as we are aware of the event.
The Management Company are available during normal office hours and can be contacted in an emergency outside of this.
- 14. Force majeure
We cannot be held responsible nor accept any liability where we are prevented from fulfilling our contractual obligations by ‘force majeure’. These include but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes and other industrial disputes, natural disaster, fire, acts of God, terrorist activities, technical difficulties with transportation and utilities, closure of ports or ferries, quarantine, epidemics, weather conditions, government action or other events outside our control. Your travel insurance may cover you in some of these events.
- 15. Limitation of Liability
The owner/booking agent or their servants does not accept liability for any death, injury, damage, loss or theft sustained by any member of your party or any person who enters the property or who uses the Resort’s facilities during your confirmed rental period either by your invitation or not. Or for any third-party claim made again a member of the party or their guests. Nor do we accept any responsibility should you leave any personal belongings behind after you have vacated the property. Guests are specifically requested not to allow unsupervised children to use the pool or be left unattended in the home. Local laws apply.
- 16. Owners Access
The owner, Booking Agent and their Management Company reserve the right of entry at any time to the property. (This includes scheduled maintenance workers for repair issues). Wherever possible they will provide reasonable notice.
- 17. Travel Insurance
It is strongly recommended that you and all members of your party take out sufficient travel insurance for the rental period and that it is adequate for your needs. In the event of the owner/booking agent being obliged to cancel your booking for reasons beyond our control, we will only be liable to refund monies already paid by the renters, no compensation will be payable.
Travel Insurance is recommended for all bookings. It is your responsibility to take it out. For most reasons beyond our control cancellation will be covered by your travel insurance. However, cancellation due to financial reasons or no longer wishing to travel is not included in your ravel insurance.
- 18. Code of Conduct
Please do not do anything that is likely to inconvenience your neighbours. There are strict rules at all resorts regarding noise especially between the hours of 11 pm and 7.30 am.
